Code of Criminal Procedure, 1973–Sec. 317–Representation of petitioner was rejected, and the bail bonds were cancelled–Justification–If the Magistrate was not agreed to allow the representation, the accused was required to be given the direction for personal appearance–In the event of noncompliance of direction, the Court could have taken the recourse of cancellation of bail bonds–Further, if the complainant was not present and trial was not taking any progress, the trial judge should not have compelled physical appearance of the accused–Impugned order and all subsequent actions quashed.
