Fatal Accidents Act, 1855–Sec. 1–Death by electrocution–Compensation–Case of the plaintiff that the current passed through the stag wire (support wire) and deceased struck with the bathroom wall–Stag wire was fastened on the bathroom wall–Tubelight was fixed on the electric pole and it turned loose due to pressure and it touched with the stag wire–Witness of Electricity Department admitted that it was the fault of Municipal Board–It cannot be said that the bathroom was constructed later on after fixing the stag wire on the government land–No insulator was fixed between the electric pole and stag wire to prevent flowing of electric current–No negligence of deceased–Compensation is also in permissible limit–However, rate of interest deserves to be reduced from 12 per annum to 6% per annum.
