Arbitration & Conciliation Act, 1996–Secs. 7 & 8–Applicability–Present dispute between the parties was at the initial stage of execution of the agreement–Despite the preliminary objection qua the existence of the concluded contract before the Arbitral Tribunal, no issue was framed–Blatent ignorance of the petitioner’s preliminary objection as well as the directions/liberty granted by the Hon’ble Apex Court vide order dated 10.12.1999–Furthermore, even after passing the award in favour of respondent, petitioner filed the objections u/s. 34 but the Court below rejected the objections–An arbitral award shall be said against the public policy of India, provided that the same is passed in contravention of the fundamental policy of Indian Law–Impugned award deserves to be set aside.
