Prevention of Food Adulteration Act, 1954–Sec. 7/16–Sample of chilly power was found adulterated–Bill showing that the packet of containing weight 20 kgs. was sold–It does not recite that the chilly powder was in four packings of 5 kgs. each–Whereas the spot memo showing that the chilly powder was lying in a packing of 5 kgs. and two samples were taken therefrom–Food inspector himself admitted that the sample was taken from an open bag–Prosecution failed to show that the sample was drawn from the same packing which was sold by petitioner–Held, proceedings deserve to be quashed.
