Rajasthan Rent Control Act, 2001–Sec. 9(1)(i)–Eviction on the ground of reasonable and bonafide necessity–Plea of tenant that the wife of landlord died during the pendency of proceeding, hence the personal and bonafide necessity ceased–Plea negated as the bonafide necessity is to be seen on the date of filing suit and subsequent events cannot render the requirement as non-existent–Land-lord is aged of 76 years–Availability of alternative accommodation to land-lord also cannot be accepted as no evidence is available to show that the alleged godown can be used as residential premises–Held, no interference is required in the findings of eviction.
