Code of Civil Procedure, 1908–Order 41, Rule 31–Scope–If the judgment of trial Court is reversed or varied by first appellate Court, then it is obligatary for it to record reasons for it’s disapproval/reversal of such findings–In the instant case, first appellate Court has decided the appeal in an absolutely casual and cursory manner without even formulating the points for determination–Impugned judgment set aside and matter remanded back for deciding afresh.
