Rajasthan Tenancy Act, 1955–Sec. 53–Limitation Act, 1963–Sec. 5– Code of Civil Procedure, 1908–Sec. 151–Preliminary decree of partition–Respondent-subsequent purchasers sought to take into consideration the subsequent sale deed executed in their favour–Application filed by them u/s. 151 was dismissed–When they realized that the remedy adopted by them was not proper, they filed the appeal which was dismissed by RAA–BOR condoned the delay of 18 months and remanded back the matter to RAA–Respondents had sufficient cause to seek for condonation of delay because the delay was caused due to the applicants having pursued an incorrect remedy–Petitioners have themselves sought the remand of the matter before the BOR for adjudication on merits–Respondents have purchased only 1/7 share, which is less than of which the vendor is entitled to under the preliminary decree–No case is made out for interference.
