Specific Relief Act, 1963–Sec. 12–Contract Act, 1872–Sec. 2(e)–Issue up to effect that whether concluded contract of sale of the shop in question has arrived at/resulted between the parties, though there is no written contract executed–Decision was taken to dispose of the shop in question which is in tenancy of plaintiffs at the rate of 200 times of the determined rent–Plaintiff unconditionally accepted the offer and deposited the whole amount of consideration in single instalment–Thereafter, it was noticed that the sale is unprofitable and the decision of dispoal committee was cancelled–Officers of Devasthan Vibhag took u-turn instead of preparing the draft of sale deed–Held, all the essential ingredients required to be fulfilled in order to bring a concluded contract in light and enforceable, stand complied–Suit deserves to be decreed.
