Penal Code, 1860–Sec. 302–Conviction–Death sentence–Reduced by High Court up to life imprisonment–Deceased Christian missionary was sleeping in the vehicle with his two children–Appellants A-1 & A-3 set fire on the vehicle and prevented the deceased from escaping–A-3 confessed his act by writing two letters and statements u/s. 313–He also avoided the arrest and remained absconded soon after the incident–Eye-witnesses specified the role of both accused and stated about the slogan raised in name of A-1–Though both the accused were identified for the first time in the Court their act was found corroborative with other evidence–Held, the conviction was justified and sentence imposed by High Court is also proper.
