Code of Civil Procedure, 1908–Secs. 10 & 151–Application u/s. 151 with contending that the power of attorney in question was obtained by fraud and a criminal case is pending in this respect–Rejection of application–Appreciation of–Suit for possession and declaration of sale deed void and ineffective–No provision in C.P.C. which can refrain the civil Court to proceed and decide the civil suit only on account of a criminal case registered in respect of the allegation which are also a part of civil proceedings–Criminal Court cannot decide as to whether the sale deed is required to be declared valid or the same is required to be set aside–Application was rightly dismissed.
