Partition–Earlier, this Court categorically held that all the properties were inherited by A by virtue of a partition deed have not been included in the suit schedule–Further view that the suit for partial partition was bad in law–First appellate Court rightly remanded back the matter for including the
remaining properties–High Court committed error in observing the judgment of this Court–Impugned judgment of High Court set aside and trial Court is directed to consider accordingly.
