Prevention of Corruption Act, 1988–Secs. 8, 13(1)(d),(e) & 13(2)–Criminal proceedings–Sustainability–Proceedings against the co-accused L have been quashed by the Co-ordinate Bench of this Court and the order has attained finality–Nothing against the petitioner except his statements recorded during the interrogation–Such has no evidentiary value–None of the contractors of 46 files were named either as a witness or as an accused–In the Departmental inquiry, no illegality has been found in all 46 files–Recovery of Rs. 13,00,000/- from the petitioner also cannot help the prosecution as the prosecution failed to collect the cogent evidence–Proceedings are liable to be quashed and set aside.
