Penal Code, 1860–Sec. 376–Conviction–Prosecutrix aged of 17 years–Medical report showing that the hymen was found intact–However, this fact was not found clear in the statements of doctor before the trial Court–Prosecutrix specifically stated that the appellant committed forcible rape on her–Delay in lodging FIR was also explained–Prosecutrix attempted to commit suicide–If the prosecution had intended to lodge a false report, there would not have taken the risk of giving a time gap of more than 20 days between the incident and the lodgement of FIR–Clinching circumstantial evidence–Held, the conviction was justified.
