Code of Civil Procedure, 1908–Sec. 96–Hearing of caveator at the stage of admission of appeal–Entitlement–Plea of appellant that merely because the respondent was given the opportunity of hearing at the time of application u/s. 5 of Limitation Act, he cannot be held entitled for hearing at the admission stage–Respondent is taking part in the appeal from the initial stage–Therefore, he cannot be precluded from the hearing at the admission stage of appeal–Objection deserves to be negated.
