Prevention of Corruption Act, 1988–Sec. 7, 13(1)(d) r/w. 13(2) & 8–Penal Code, 1960–Sec. 120B–Conviction–Appreciation of–Transcription of conversations clearly disclosed the demand and consent for illegal gratification–Though the complainant turned hostile, yet the transcript of the conversation at the time of the bribe transaction and dubbed communications have been exhibited along with the certificate u/s. 65-B–Appellant no. 2, who is not a public servant, accepted the bribe pursuant to the directions of appellant no. 1–Tainted money was recovered from the conscious possession of the appellant no. 2–Chain of circumstantial evidence is complete–Held, conviction was justified.
