Code of Civil Procedure, 1908–Sec. 11–Res-judicata–Applicability in same suit–For applying the resjudicata at subsequent stage of the same suit, it is necessary that the issue sought to be raised at the subsequent stage must have been raised as preliminary stage itself and the Court should have adjudicated the issue on merits at the earlier stage.
