Code of Civil Procedure, 1908–Order 6, Rule 17–Amendment in pleadings–Dealing with the application–Relevant considerations-
(i) Merits of the averments sought to be incorporated by way of amendment are not to be judged at the stage of allowing prayer for amendment,
(ii) The dominant purpose of the amendment is to minimize the litigation.
(iii) The amendment once allowed and incorporated relates back to the date of initial institute of the suit
(iv) The Court, however, in appropriate case may restrict the application of the amendment from the date the amendment is allowed.
