Code of Civil Procedure, 1908–Order 18, Rule 3–Trial Court allowed to confining the plaintiff’s evidence to the extent of issue no. 2–Provisions of Order 18, Rule 3 permits a party to lead the evidence in rebuttal by way of answers of the evidence by the other party only on those issues burden of which lays upon the other party–Burden of proof of the issue no. 2 was on the defendant–Petitioner-plaintiff cannot be allowed to fill the lacuna in his evidence in the grab of rebuttal evidence–Impugned order does not suffer from any jurisdictional error or illegality.
