Prevention of Food Adulteration Act, 1954–Secs. 2(1a)(f), 16(1A) & 16(1)(a)(ii)–Conviction–Sustainability–Sample of Haldi Powder was found to contain four living mealworms and two live weevils–Medical Officer admitted in cross-examination that he did not find any weevils/worms in the sample on seeing it with naked eyes–No evidence to show that the samples have not tampered within the intervening period till reaching the laboratory–Further, report of public analyst does not mention that the sample was either insect infected or was unfit for human consumption–Requirements of Sec. 1(1a)(f) were not established by the prosecution–Held, conviction can not be sustained.
