Code of Civil Procedure, 1908–Order 21, Rule 98–Specific Relief Act, 1963–Sec. 12–Issuance of warrant of possession by rejecting the objection–Under challenge–Decree of specific performance was moulded by directing payment of Rs. two crores against the advance paid meagure amount of Rs. 25,000/- –Appellant has been unnecessarily delaying and causing obstruction in the execution of the decree–Additionally, his suit for permanent injunction based upon his possession was dismissed and judgment has attained finality–He wants to take undue advantage of an omission of the judgment wherein this Court did not clarify that possession would be handed over to the respondent upon receipt of the amount awarded–He cannot insist that the respondent should file a separate suit for possession–Appeal deserves to be dismissed with cost of Rs. ten lakh.
