Code of Criminal Procedure, 1973–Secs. 167(2)–Scope–If the chargesheet is filed by the police prior to the expiry of 60 or 90 days but the same is returned back by the Court for whatever reason, even then, on the expiry of the stipulated period, the accused has a right to seek the bail as on the day when the prayer is made for bail, the charge sheet was not available with the Court.
