Code of Civil Procedure, 1908–Order 9, Rule 13–Plea of petitioner that A was not the original party in the suit, therefore, he was not competent to move the application under Order 9, Rule 13–Plea deserves to be negated because the application of R under Order 1 Rule 10(2) for treating the A, stranger in the suit was dismissed by the trial Court and the order attained finality–Further, the property was transferred to A, and he was having the interest in the property as the owner.
