Hindu Succession Act, 1956–Sec. 6 (As amended by the Act of 2005)–Right of daughter to coparcenary property–Amended provisions cannot be given retrospective effect–Rights under the amended provision are applicable to the living daughters of living coparceners as on 9th September 2005 irrespective of when such daughters are born–Partition had been taken place before 20-12-2004–It will remain unaffected–Impugned order passed by High Court set aside and matter remanded back for deciding afresh.
