Penal Code, 1860–Secs. 419 & 420–Conviction –Sustainability–Petitioner was found writing in the examination hall for other person but the copy allegedly seized from the petitioner was not produced before the Trial Court –It was the important document on which the writing of the petitioner would have fortified that he was committing cheating by personation–Conviction u/s. 419 deserve to be set aside–No allegation that he induced anyone to deliver any property or to make, alter or destory any valuable security–Offence u/s. 420 is not made out.
