Penal Code, 1860–Secs. 420, 467, 468, 471 & 120-B–FIR for the offence–Sustainability–Dispute is in regard to the performance of the agreement of sale between the parties–Responsibility of the party to not act as per agreement can be decided only by a competent civil Court–It was known to the complainant the intervening circumstances of pendency of writ petition before the High Court for the same property–Petitioners sent the legal notice to him disclosing the details of the developments of the pending matter–He did not reply the notice and kept mum–Held, allegations for the offence u/s. 420 are not made out–Further held, it is not a case of making any false document or using it as genuine–No offence is made out u/ss. 468, 471 & 120-B–FIR deserves to be quashed.
