Passports Act, 1967–Sec. 6(1) & (2)–Denial from issuance of passport–In the criminal case pending against the petitioner, the Investigation Officer has submitted the negative final report and for some reasons or the other, the same has not been accepted by the Court for last one year–Neither the memorandum dated 10.10.2019 nor the provisions of clause (f) of sub-section 6(2) put an embargo upon issuance of the passport in such case where the negative final report has been furnished–Case of petitioner cannot be held to be covered by the expression “proceedings in respect of an offence alleged to have been committed by the applicant pending before a Criminal Court of India”–Directed to issue the passport.
