Bharatiya Nagarik Suraksha Sanhita, 2023–Sec. 430 [Corresponding Sec. 389 of Cr.P.C. ]–Penal Code, 1860–Sec. 302/34–Suspenstion of sentence during the pendency of appeal–Deceased was father of applicant’s three minor children–No one is there to take care the children–They cannot be left to live alone in their house–They will have to remain in jail per-force–It would be expedient and in interest of justice to suspend the sentence of the applicant subject to certain conditions.
