Code of Civil Procedure, 1908–Order 22, Rules 4 & 9–Abatement of the revision as a whole for not substituting the LR’s. of the second respondent–Justification–Merely because the second respondent’s LR’s. were not impleaded and the revision stood abated with respect to him, it cannot stand abated against other respondents–High Court clearly erred in dismissing the civil revision–Further, the LR’s. of the second respondent are also desirous for appearing in the civil revision and agitating their cause–Held, civil revision should be restored.
