Penal Code, 1860–Secs. 498-A & 406–High Court quashed the criminal proceedings qua the accused no. 6 and at the same time, dismissed the petition qua the accused no. 6–Accused no. 6 is the husband of accused no. 5 and accused no. 5 is the wife of the cousin of the main accused–Allegations against accused nos. 5 & 6 are general and omnibus in nature–They were living in Mohali, in a different city than the matrimonial home of complainant’s daughter–Complaint was filed subsequent to the grant of divorce between the first accused and complainant’s daughter–When the subject FIR and all further proceedings qua the accused no. 6 were quashed, High Court ought to have interfered and quashed the proceedings qua the accused no. 5–Impugned order qua the accused no. 5 is liable to be set aside.
