Rajasthan Public Trust Act, 1959–Secs. 37 & 2(11)–Land acquisition–Land of temple was acquired for the construction of Highway and the amount of compensation was released in favour of Commissioner, Devasthan Department–Prayer of the petitioner that the amount should be released in favour of trust of the temple–Circular dated 11.06.2020 clearly states that the amount of compensation of temple land shall not be receivable by the pujari/trustee–Petitioner has no right to claim the compensation amount–It has also been provided that how the compensation in lieu of acquisition of temple land is to be utilized–Commissioner is deemed to be a Treasurer of the charitable endowments in the State of Rajasthan–Temple in question is regd. public trust and comes in the definition of Public Trust–Held, the petitioner is not entitled to get the claimed relief.
