Penal Code, 1860–Secs. 304-B, 498-A, 176 & 201–Conviction–Sustain ability–Conviction based on the ground of testimony of the prosecution witnesses –PW 13 who lodged the complaint, was found hearsay witness and he was declared hostile by the prosecution–PWs. 1, 2, 3, 4, 5, 7, & 9 stated nothing against the appellants–PWs. 10, 11 & 12 were found formal witnesses–Held, findings recorded by trial Court are not sustainable and are liable to be quashed and set aside.
