Dismissal of Claim Petition–Compensation was allowed by Tribunal–In appeal, High Court dismissed the claim on the grounds that the involvement of vehicle was not proved, the testimony of U was not reliable and FIR was delayed for four months–Complainant was lodged and it was forwarded to SSP Hisar from SSP Hanumangarh–View of High Court that no one came from the office of SSP Hisar to prove the complaint, is not acceptable–It was not in control of appellant who is an ordinary village woman–Further held, no reason is existed for throwing the testimony of U and strict rules of evidence
cannot be invoked in claim cases–Approach of High Court was not justified–Order set aside and award of Tribunal restored.
