Code of Criminal Procedure, 1973–Secs. 439, 306 & 482–Petitioner was granted pardon by the competent Court u/s. 306 and was made an approver–He honoured his side of the bargain by testifying against the co-accused persons–Provisions of Sec. 439 would not apply to his case because he is not an accused any longer after having been tendered parden–He deserves to be enlarged on bail by exercising the powers of Sec. 482.
