Penal Code, 1860–Secs. 307 or 326–Conviction–Proper Section–The root cause of incident was the inappropriate relation of injured with the appellant’s wife–This fact was admitted by the injured–Weapon used in the offence was small scissors which are used by the tailors–Act was not pre-planned and injuries were not caused with the intention of causing the death–Conviction altered u/s. 326 and the sentence reduced up to the period of already undergone.
