Code of Civil Procedure, 1908–Order 8, Rule 1A(3)–Scope–Provision confers discretion on the trial Court to admit documentory evidence at a later stage when not filed with the written statement–But the said discretion cannot and ought not to be exercised on the mere askance without reference to the facts relevant for it’s exercise.
