Negotiable Instruments Act, 1881–Sec. 138–Dismissal of complaint for want of presence and failure to comply with the direction–Justification–If the new address of the accused was not produced by the petitioner, the same could not have been the ground for rejection of complaint–Further, the order sheet of case reveals that the petitioner’s counsel was regularly appearing and the complaint was dismissed merely on the basis of absence on one date–Impugned order is not justified and deserves to be set aside.
