Penal Code, 1860–Sec. 423–Order of taking cognizance on the ground of protest petition–Set aside by revisional Court–Land was sold by stating that no case is pending in regard to land–Case was pending before the Board of Revenue and order of stay was in effect–This facts was forbidden in sale deed–Held, revisional Court was not justified in setting aside the order of taking cognizance.
