Motor Vehicles Act, 1988–Secs. 10 (As amended in the year 1994) & 166–Driver of offending vehicle was having the licence to drive the vehicle of the H.G.V. category only whereas he was driving a heavy passenger bus–It was required for him to posses the licence of H.P.V. or authorization of H.P.V. on his existing licence–Breach of conditions of policy–Victim was the third party–Held, appellant-Insurance Company is liable to pay the amount of compensation with the liberty to recover the same from the owner of the vehicle.
