Prevention of Corruption (Amendment) Act, 2018–Sec. 5–Application by Investigation Agency asking for voice sample of petitioner-accused–Whether the Judicial Magistrate can deal with the application ?–Held, yes–When the application with regard to drawing of voice sample was moved, even the charge sheet had not been filed, there was no question of trying the accused–Application was filed during the investigation and much prior to commencement of trial–However, the Magistrate cannot pass an order regarding the future course of action that may or may not be adopted by the trial Court during the course of trial–Observations of Magistrate regarding the adverse inference against the petitioner are liable to be set aside.
