Negotiable Instruments Act, 1881–Secs. 138 & 139–Constitution of India, 1950–Art. 21–Reversed presumption provided u/s. 139–Presumption in favour of holder and accused is to disprove his guilt–Held, in such situation fair trial becomes stronger–Hence this right deserves to be protected more strongly and emphatically than in ordinary criminal offence under the Penal Code.
