Permanent Injunction & Declaration–Suit for–Decreed–Plaintiffs sought the declaration in regard to existed way–They proved that the way in question is existed at the sight, and they are using the same since the time of their predecessors–It was also proved that no other alternative way is available to them–Defendant’s witnesses admitted the fact of trail–Report of Commissioner was also found corroborated, and it was not challenged–Observation of trial Court that pendency of application u/s. 136 of Rajasthan Land Revenue Act cannot affect the declaration of way–Findings recorded by the Courts below are based on appreciation of evidence–No case is made out for interference.
