Criminal Trial–Identification of accused’s–Incident occurred at the night around 3-00 am at the place where there was no proper light–Source of light is not clear–It is not clear that how the forest officers were having sufficient light to see the accused for the purpose of subsequent TIP–High Court wrongly appreciated the evidence of identification.
