Hindu Succession Act, 1956–Sec. 8–Deceased Govt. servant died intestated–His properties would be divided among the first class heirs i.e. mother and wife of deceased would be included–However, the family pension does not form part of the estate of the deceased–An employee has no right to dispose the same in his will by giving a direction or someone other than the one who is entitled to it–High Court committed error in giving direction that the respondent-mother would get 50% share of pension.
