Motor Vehicles Act, 1988–Secs. 5/180, 32/192 & 66/192–Criminal Prosecution–Scope for remaining continue–Bus was seized for want of registration certificate, valid permit and driving licence–However, S.H.O. mentioned in inspection note that registration certificate and permit were taken into possession–Contradictory situation–He neither demanded the licence nor gave the reasonable opportunity for producing the licence–Sec. 3 of Act provides that no person shall drive a motor vehicle in any public place unless he holds an effective licence–Same does not mean that holder of licence has to carry the licence at all times while driving the vehicle–Complaint was filed with malafide intention–Quashed qua the petitioner.
