Penal Code, 1860–Secs. 166, 191, 192, 199, 415, 420, 468, 499, 500 & 120B–Order of taking the cognizance–Set aside by the revisional Court–Appreciation of–Cognizance for the offence u/s. 193 was contrary to the legal provisions–In regard to the offences u/s. 420, 500 & 120-B, only the statements of complainant are available on the record and nothing else–Even, the false FIR was lodged against the petitioner for the offences u/ss. 420, 467, 469, 120-B, he could seek the civil remedy for malicious prosecution–Complaint filed by the petitioner was not maintainable and it was rightly rejected by the revisional Court.
