Narcotic Drugs & Psychotropic Substances Act, 1985–Sec. 52–Code of Criminal Procedure, 1973–Secs. 451/457–Custody of vehicle–Whenever there is an inconsistency between the Cr.P.C. and N.D.P.S. Act, Sec. 51 of N.D.P.S. Act shall operate and Cr.P.C. shall have to take a back seat–Release of the vehicle even when it was opposed by the Narcotic Control Board on the count of Sec. 52A could not have been allowed–The auction of the vehicle being opposed is contrary to law–Impugned order passed by the Special Judge set aside and directed to release the vehicle in favour of Narcotic Control Bureau.
