Rajathan Rent Control Act, 2001–Sec. 9(g)–Eviction petition–Allowed–Appreciation of–Plea of petitioner-tenant that he purchased a shop and acquired the possession on 17.12.1999 i.e. prior to commencement of Act of 2001–Petitioner-tenant had mere hope and expectation at the time when the Act of 1950 was in force that availibity of suitable commercial premises would not be a ground for eviction–It would not give rise to a vested and accrued but the enactment of new Act would provide a ground of eviction to the landlord of vacant possession of even commercial premises has become available to the tenant which is suitable and adequate for his requirement–Merely delayed filing of eviction petition would not be considered either waiver or acquiescence on the part of landlord.
