Code of Civil Procedure, 1908–Order 18, Rule 3–Trial Court refused to mark the document as exhibit–Justification–Document was placed on the record after allowing the application under Order 7, Rule 14–Once the document is ordered to be taken on the record, the trial Court has erred in not marking the document as exhibit–Further, the request made by the plaintiff to reserve the right of producing evidence in rebuttal was also illegally rejected–Trial Court is directed accordingly.
