Code of Civil Procedure, 1908–Order 7, Rule 14(3)–Dismissal of application with the view that the matter is at the stage of evidence and if the additional documents are taken on record, it will lead to further complications–Consequent to framing the new issues, petitioner was entitled for filing the application–There was no occasion for him to file the questioned documents on record and it arose only after the amendment in issues–Trial Court rejected the application without examining the issue in its entirety–Application deserves to be allowed.
