Code of Civil Procedure, 1908–Order 7, Rule 11–Representation of People Act, 1951–Sec. 83–Prayer for rejection of election petition–Dismissed–Justification–Election petition was filed with the allegations of corrupt practice and improper acceptance of nomination–Bald and vague allegations in the election petition without stating the material facts in support thereof as required u/s. 83(1) (a) of the Act–Election petition lacks a concise statement of “material facts” as contemplated in Sec. 83(a) and lacks “full particulars” of the alleged corrupt practice as contemplated u/s. 83(b) of the Act–Respondent no. 1 himself has not raised any objection in writing against the nomination filed by the appellant–An omission of a single material fact leading to an incomplete cause of action or omission to contain a concise statement of material facts on which the Election petitioner relies for establishing a cause of action, would entail rejection of Election Petition under Order 7, Rule 11 r/w. Secs. 83 & 87 of the Act–Election petition deserves to be dismissed.
